The Parties
This Coaching Agreement ('Agreement') is entered into between:

Registrants of the Happiness Hygiene Program (indicated by selecting the “I agree to the coaching agreement” checkbox upon registration)
Together referred to as 'the parties'.
1. The Program
1.1 What is included
The Coach agrees to provide the Happiness Hygiene 66-Day Accountability Coaching Program ('the Program'), which includes:
One (1) × 60-minute Planning Session (Prior to the start of term)
One (1) × 30-minute mid-point review call (end of Week 1)
One (1) × 30-minute closing one-on-one session (end of Week 2)
Seven (7) × weekly group coaching calls
Daily text check-ins via WhatsApp for the full 66 days
Lifetime access* to the Happiness Hygiene private Facebook community
*For as long as the Happiness Hygiene Facebook community is in operation
1.2 Program format
All one-on-one sessions will be conducted via video call (Google Meet or equivalent). Group calls will be conducted via the same platform. Call times will be agreed between the parties prior to commencement.
1.3 What is not included
The Program does not include:
Psychological assessment, diagnosis, or treatment of any kind
Crisis intervention or emergency mental health support
Medical, nutritional, or psychiatric advice
Sessions beyond those listed in clause 1.1
Individualised therapeutic support during group call sessions
2. Investment & Payment
2.1 Program fee
The total investment for the Program is AUD $397
2.2 Payment terms
Payment is due in full prior to the commencement of the Program. The Program will not begin until payment has been received and cleared.
2.3 GST
The Coach is not registered for GST.
3. Cancellation & Refund Policy
3.1 Cancellation by the Client
The Client may cancel their participation in the Program by providing written notice to the Coach at courtneymthorpe@outlook.com
The following cancellation terms apply:
Cancellation before the Planning session has taken place: full refund, less a $50 administration fee.
Cancellation after your Planning session is on a prorated basis from the start of term, less a $100 Planning session fee.
3.2 Cancellation by the Coach
The Coach reserves the right to cancel the Program in exceptional circumstances (including illness or personal emergency). In the event of cancellation by the Coach:
Where the Program has not commenced: a full refund will be provided.
Where the Program has commenced: a pro-rata refund will be provided for the unused portion of the Program.
3.3 Missed sessions
If the Client misses a scheduled one-on-one session without providing at least 24 hours' notice, that session is forfeited. The Coach will make reasonable efforts to reschedule if notice is provided within the required timeframe, subject to availability.
Group call sessions cannot be rescheduled individually. If the Client is unable to attend a group session, they will not receive a one-on-one substitute.
4. The Coaching Relationship
4.1 Nature of coaching
Coaching is a collaborative, forward-focused professional relationship designed to support the Client in developing habits, clarity, and accountability. The Coach does not provide psychological therapy, counselling, or any form of mental health treatment.
The Coach is not a registered psychologist, psychiatrist, or medical professional. Nothing in this Program or in communications between the parties constitutes medical or psychological advice.
4.2 Client responsibility
The Client acknowledges that:
The results of the Program depend significantly on the Client's own effort, engagement, and commitment.
The Coach cannot guarantee specific outcomes. Happiness, habit formation, and wellbeing are influenced by many factors outside the coaching relationship.
The Client is responsible for their own decisions and actions throughout and after the Program.
The Client will communicate openly and honestly with the Coach to enable the Program to be tailored effectively.
4.3 Mental health and suitability
The Client confirms that they are not currently experiencing a mental health crisis, acute psychological distress, or a condition that would be more appropriately addressed by a registered mental health professional. If the Client's circumstances change during the Program, they agree to inform the Coach promptly.
The Coach reserves the right to refer the Client to seek professional support and, if necessary, to suspend or terminate the coaching relationship if it becomes apparent that the Client's needs fall outside the scope of coaching.
5. Confidentiality
5.1 Coach obligations
The Coach will hold all information shared by the Client in confidence and will not disclose it to any third party without the Client's written consent, except where required by law or where the Coach believes there is a risk of serious harm to the Client or others.
5.2 Group program confidentiality
During the group call phase of the Program (after week 3 & onwards), the Client will be participating alongside other clients. The Client agrees to maintain the confidentiality of all other participants - not sharing, discussing, or repeating any information shared by other group members outside of the group context.
5.3 Client obligations
The Client agrees not to record any sessions without the prior written consent of the Coach.
6. Intellectual Property
All materials provided by the Coach as part of the Program - including session frameworks, tools, worksheets, and any written or recorded content - remain the intellectual property of Happiness Hygiene. The Client may use these materials for their own personal development and may not reproduce, share, or commercialise them without the written consent of the Coach.
7. Limitation of Liability
To the maximum extent permitted by Australian law, the Coach's total liability to the Client for any loss or damage arising from or in connection with the Program shall not exceed the total amount paid by the Client for the Program.
The Coach is not liable for any indirect, consequential, or special loss or damage, including loss of income, loss of opportunity, or emotional distress arising from participation in or termination of the Program.
Nothing in this clause limits any rights the Client may have under the Australian Consumer Law that cannot be excluded by agreement.
8. Termination
Either party may terminate this Agreement by providing written notice if the other party materially breaches any term of this Agreement and fails to remedy that breach within 7 days of written notice of the breach.
The Coach may terminate this Agreement immediately and without notice if the Client behaves in a manner that is abusive, threatening, or otherwise unreasonable toward the Coach or other program participants.
Upon termination, the refund provisions in clause 3 apply.
9. Governing Law
This Agreement is governed by the laws of New South Wales, Australia. Any disputes arising from this Agreement will be subject to the jurisdiction of the courts of New South Wales.
In the event of a dispute, both parties agree to attempt to resolve the matter through good faith discussion before commencing formal legal proceedings.
10. Entire Agreement
This Agreement constitutes the entire agreement between the parties in relation to the Program and supersedes all prior discussions, representations, and agreements. Any variation to this Agreement must be in writing and signed by both parties.

By registering for the Happiness Hygiene Program, both parties confirm they have read, understood, and agree to the terms of this Agreement.
